KALISPELL, Mont. (AP) – A temporary man has been arrested and charged with a shooting outside a Kalispell fitness center that killed the center’s manager and injured another man.
The indictment was filed on Tuesday and District Judge Dan Wilson issued an arrest warrant for Jonathan Douglas Shaw, 35, on Wednesday for willful and attempted homicide for the September 16 shooting.
Shaw was jailed Wednesday after being released from the hospital, according to Flathead County Jail records. His bail is set at one million dollars.
Shaw is charged with killing Fuel Fitness manager Matthew Hurley and injuring another man who heard the first shots, grabbed his own gun and exchanged shots with Shaw.
Hurley and assistant manager Matthew Underhill had told Shaw that he could no longer live in his vehicle in the fitness center parking lot and that they would refund the remainder of his membership, court files say. Underhill told investigators that when Shaw was told he was only getting a partial refund, Shaw said, “Well, you’re going to die,” and started shooting Hurley, prosecutors said.
Shaw’s indictment is scheduled for October 28th. According to the clerk, he was not assigned a public defender.
